Regulatory status
Esmero Soluciones de México, S.A. is a regulated telecommunications operator under the Ley Federal de Telecomunicaciones y Radiodifusión (LFTR). Operations under the Concesión Única regime (Article 118 LFTR) and the mandatory SMS interconnection regime (Article 127 LFTR). Compliance with NOM-184-SCFI (consumer protection) and the REPEP (Registro Público para Evitar Publicidad).
Note: the IFT is currently in institutional transition to the Agencia de Transformación Digital y Telecomunicaciones, pending the issuance of secondary legislation under the 2025 constitutional reform.

Data controller
Esmero Soluciones de México, S.A. (the "Responsable") is the data controller for personal data collected through this website and through any contractual or pre-contractual relationship, in accordance with the Ley Federal de Protección de Datos Personales en Posesión de los Particulares (LFPDPPP) and its Regulations.
Personal data and purposes
The Responsable processes personal data for the following purposes:
- Commercial enquiries and sandbox requests. Name, work email, company, country, use case description.
- Contractual relationship. Identification and billing data of partners, integrators and carriers under signed agreements.
- Regulatory compliance. Data required under the LFTR, NOM-184-SCFI and REPEP regulations.
ARCO rights
Under Article 16 LFPDPPP, data subjects may exercise their rights of Access, Rectification, Cancellation and Opposition (ARCO rights), and revoke consent at any time, by writing to privacidad@chadeva.mx. The right to lodge a complaint with the INAI (Instituto Nacional de Transparencia, Acceso a la Información y Protección de Datos Personales · www.inai.org.mx) is reserved.
REPEP & commercial communications
This Responsable consults the REPEP (Registro Público para Evitar Publicidad de la Profeco) before sending any commercial communication. Numbers registered in REPEP do not receive promotional SMS or calls from our platform. Express consent is obtained from end users before any promotional communication, in accordance with Article 4.9 of NOM-184-SCFI.
